INTERNET SERVICE AGREEMENT
GENERAL INFORMATION & REQUIREMENTS
All Subic Telecom clients should
carefully read and understand the following terms and conditions.
Upon signing this Agreement, our new client/s must return
this document duly signed, accomplished Internet Access Application
Form and other application requirements.
The Subic Telecom Internet service
is designed to meet the needs of individuals, groups, organizations,
agencies and corporations desiring an affordable means of
accessing the Internet. Subic Telecom Internet Service requires
client/s to have the following requirements – a personal
computer equipped with a monitor, telephone line (required
for DSL only), operating system – Windows 98, 2000 or
NT, Mac 7.7 up, Linux 2.2.12, Hardware – Pentium II
up, Hard Drive Space – 150 MB up, Memory – 64
MB RAM up, Browser – MS Internet Explorer, Netscape
Navigator, Ethernet Card – 10 Base-T and CD-ROM Drive,
Sound Card, speaker, Video Card with at least 4 MB.
IMPLEMENTATION
- The Client before installation, will provide access to
Subic Telecom personnel to conduct site surveys for proper
planning of the installation process. The same access will
likewise be provided during the installation period.
- The Client shall provide, at its expense, upon the signing
of this Agreement, the following requirements for the provisions
of the line:
- All necessary in-house conduits &/or cable raceway
for the layout between the cable entrance and the Main
Distribution Frame (MDF)
- All house wiring from the MDF to the end-user’s
telephone unit, computer or networking equipment shall
be provided by the Client at its own expense.
- In case there will be a request to transfer the equipment,
relocation or reinstallation due to office renovation,
change of address, or any other reasons, the cost that
may be incurred therefore shall be for the account of
the Client.
- As soon as the Internet access is activated, testing
such a Ping, Trace Route, E-mail and FTP will be conducted
together with the Client’s representative.
PAYMENT TERMS
- The Client shall pay Subic Telecom all the required charges
as indicated in the Proposal and any revisions thereof.
- All the charges referred to the Proposal shall take effect
one day after the Subic Telecom’s Internet Service
has been activated and turned over to the Client for its
official use. Upon activation of Subic Telecom’s Internet
Service, Subic Telecom will issue the proper invoice which
shall be paid by the Client in accordance with item no.
4 of the payment terms.
- If the Subic Telecom Internet Service has been provided
to the Client on a day other than the first day of the month,
it will only be the monthly service fee that will be computed
on a pro-rata basis for the first billing month. The whole
month charges shall be billed onwards. The installation
fee shall be billed in full.
- The Client shall pay the charges to Subic Telecom one-month
in advance upon receipt of Subic Telecom’s proper
invoice within the first week of each month.
- If the Client does not pay within 30 days after the invoice
date, delinquency charges amounting to 1% per month of the
outstanding balance shall be imposed. Failure to pay the
charges by the Client on or before the due date shall authorized
Subic Telecom to temporarily or permanently disconnect its
services to the Client w/o need of prior notice or demand
until the Client’s account is fully paid &/or
updated for two (2) consecutive months.
- In any case, the termination of the Subic Telecom Internet
Service/Agreement shall not prejudice Subic Telecom’s
right to collect all unpaid charges.
- Reconnection of Subic Telecom’s Internet service
will require full payment of the outstanding balance including
corresponding charges for late payment and an applicable
reconnection fee of PhP 800 if the service was suspended
within one (1) week or PhP 1,700 for over one (1) week.
- By notifying its Clients one (1) month in advance through
announcements made over its host server, Subic Telecom may
modify/amend the terms and conditions related to changes
in the services it offers, operating procedures or any adjustments
in the service fees, charges or prices it wishes to make.
The Client on the other hand, may terminate his subscription
by serving one (1) month’s notice in writing to Subic
Telecom.
ACCEPTANCE OF SERVICE
Upon activation of the Internet Service and testing such
as Ping, Trace Route, E-mail and FTP will be conducted together
with the Client’s representative, the Client shall either
accept the service or require Subic Telecom to conduct further
testing through a written notice. However, Subic Telecom reserves
the right to refuse to perform any further testing. In case,
Subic Telecom chooses not to perform further testing, Subic
Telecom will commence billing after activation/acceptance
of the Internet Service. |
